1. Who these terms are between

This website at wellbeingchiropracticqueenslandtec.site is operated by Wellbeing Chiropractic Queensland Pty Ltd (ABN 95 701 299 498, ACN 701 299 498), a proprietary company registered in Australia with its registered office in VIC 3122 (“we”, “us”, “our”). By accessing or using this website you agree to these Terms of Use. If you do not agree with them, please do not use the site.

2. The website is general information only

The content on this website describes the services we offer and explains, in general terms, how chiropractic assessment and care work. It is not clinical advice and it is not a substitute for a consultation. Nothing on this site should be relied on to diagnose, self-treat or delay seeking care for any complaint.

No practitioner–patient relationship is created by reading this website or by sending an enquiry through it. Such a relationship begins only when you attend an appointment and a practitioner accepts you for care.

If you are experiencing a medical emergency, call 000 or attend your nearest emergency department. Do not use the enquiry form.

3. Permitted use of the site

We grant you a limited, non-exclusive, non-transferable and revocable licence to access and view this website for your own personal and non-commercial use. You must not:

  • copy, reproduce, republish or redistribute any part of the site except as permitted by the Copyright Act 1968 (Cth);
  • use the site for any unlawful purpose, or in a way that damages, disables or impairs it;
  • attempt to gain unauthorised access to the site, its host server or any connected system;
  • use any automated system to scrape, harvest or index the site other than a conventional search-engine crawler;
  • use our name, marks or content in a way that suggests an association, endorsement or affiliation that does not exist.

4. Intellectual property

All content on this website — text, layout, design, illustrations, diagrams, code, and the company name and wordmark — is owned by us or licensed to us, and is protected by the Copyright Act 1968 (Cth) and other applicable laws. Except as expressly permitted in clause 3 or by law, no part of it may be reproduced, adapted or communicated to the public without our prior written consent.

5. Enquiries you send us

When you send an enquiry, you are responsible for the accuracy of what you tell us. Please do not send information that is confidential to a third party, and please keep sensitive health details to the minimum needed to arrange an appointment. We handle everything you send in accordance with our Privacy Policy. Email is not an encrypted channel and we cannot guarantee the security of a message in transit.

6. Appointments, fees and cancellations

An enquiry is a request, not a booking. An appointment is made only once we confirm the time with you in writing. Fees applicable to your appointment will be advised to you before treatment is provided, and no treatment is delivered without your informed consent to the proposed care and its cost.

If you cannot attend, tell us as early as you reasonably can so the time can be offered to someone else. Any cancellation terms that apply to your appointment will be stated at the time it is confirmed.

7. Your rights under the Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Among other things, services must be supplied with due care and skill, be fit for any purpose you told us about, and be supplied within a reasonable time.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded. To the extent that any provision of these terms would have that effect, it does not apply.

Where we are permitted to limit our liability for a failure to comply with a consumer guarantee in relation to services that are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

8. Limitation of liability

Subject always to clause 7, and to the maximum extent permitted by law:

  • this website is provided on an “as is” and “as available” basis, and we do not warrant that it will be uninterrupted, error-free, or free of harmful components;
  • we exclude all implied representations and warranties in relation to the website that are not expressly set out in these terms;
  • we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or opportunity, arising out of your use of or inability to use this website;
  • our total aggregate liability arising out of or in connection with this website, however caused, is limited to the resupply of the relevant information or the reasonable cost of having it resupplied.

Nothing in this clause limits any liability that cannot be limited at law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

9. Indemnity

You agree to indemnify us against any loss, damage, cost or expense we reasonably incur arising from your breach of these terms or your unlawful or negligent use of this website, except to the extent that the loss was caused or contributed to by us.

10. Third-party links

This website may from time to time refer to external organisations or regulators. We do not control those third parties and we are not responsible for their content, their availability, or their privacy practices. A reference is not an endorsement.

11. Availability and changes to the site

We may change, suspend or withdraw all or part of this website at any time without notice, including for maintenance, security or operational reasons. We do not guarantee continuous availability and we are not liable if the site is unavailable at any particular time.

12. Termination

We may suspend or terminate your access to this website immediately, without notice, if we reasonably consider that you have breached these terms, used the site unlawfully, or acted in a way that risks harm to the site, to us or to another user. Clauses 4, 7, 8, 9 and 15 survive termination.

13. Changes to these terms

We may amend these terms from time to time. The amended version takes effect when it is published at this address, and the date at the top of this page shows when it last changed. Your continued use of the site after publication constitutes acceptance of the amended terms.

14. General

If any provision of these terms is found to be invalid or unenforceable, it is severed to the extent of the invalidity and the remaining provisions continue in full force. A failure or delay by us in exercising a right is not a waiver of that right. These terms, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of this website.

15. Governing law and jurisdiction

These Terms of Use are governed by the laws of the State of Victoria (VIC), Australia, and by the Commonwealth laws of Australia that apply there. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.
